Final 2023 Session Report

After 60 grueling days, it is finally over. The 2023 Florida Legislative Session ended at 11:00 am Friday, May 5.  While This session was one of the highest-yielding sessions in state memory with 356 of the1,873 bills filed this session making it to Governor DeSantis’s desk.   


With supermajorities in both legislative chambers, Republicans passed historic legislation, giving Governor Ron DeSantis a win on nearly every item on his legislative agenda. But many of the measures passed, further a sharply conservative agenda, with the governor signing into law a new six-week abortion ban as well as permitless carry of concealed firearms. The legislature also passed a fix in the “resign-to-run” law allowing those running for President or Vice President of the United States to maintain their current office while seeking higher office.

 

Lawmakers also passed a $117 billion budget this session which is 6.4% higher than the current fiscal year budget which ends June 30th. Governor DeSantis has line-item veto power over all items in the budget and is expected to act on the bill this month.


With the budget, the legislature passed an accompanying $1.3 billion tax package which includes a series of expanded sales-tax “holidays” on back-to-school items, disaster-preparedness gear, and summer events. The package, which DeSantis is expected to sign, also would trim a commercial-lease tax, and give tax breaks on purchases ranging from diapers for babies and adults to cattle fencing, firearm-storage devices and gas stoves.


On the solar energy front, it was thankfully a quiet session. No net metering changes were proposed this legislative session.  The most notable legislation that passed was Chief Financial Officer Jimmy Patronis’s Consumer Protection legislation, HB 1185 by Giallombardo, that adds additional disclosures to the list of those already required at the point of sale.


Specifically, the bill adds three disclosures related to the sale or lease of a distributed energy generation system which must be separate from the agreement between the seller and buyer. The bill also requires the form to include the customer contact center phone number for the Department of Business and Professional Regulation.


SB 284 – Energy by Senator Brouder also passed this year. The bill revises the vehicle procurement requirements for the state purchasing plan. The bill requires, when available, the use of ethanol and biodiesel blended fuels and natural gas fuel when a state agency purchases a vehicle with an internal combustion engine and requires the Department of Management Services to make recommendations, regarding the procurement of electric vehicles and natural gas fuel vehicles along with the best practices for integrating these vehicles into existing fleets.  


The bill was amended at the last minute on the House floor to remove the provision that allows private providers to inspect the installation of electric vehicle charging stations and solar energy and energy storage installations or alterations due to objections of the House sponsor, Representative Caruso.


The ‘solar schools’ bill, HB 195 by Rep. Cross ultimately died on the calendar before being pulled up for a vote. Under the bill, upgrades designed to improve the hardiness and energy independence of educational facilities will be exempted up to $2 million from the cost per student station limitation imposed on school construction. Energy efficiency investments, coupled with upgrading solar technology, will allow school districts to tackle their high energy costs, make them more secure and resilient, and create an opportunity to integrate renewable energy technology into STEM curriculum.


On the budget front for energy, the legislature provided the necessary authority for the Florida Department of Agriculture and Consumer Services Office of Energy to pull down the federal funding coming to Florida this fall through the Investment Infrastructure and Jobs Act and the Inflation Reduction Act.  This will provide the Office of Energy with the initial funding needed to create the state spending plan and set up the necessary infrastructure and staff to disseminate the funding.
